Avondale, AZ Custody Attorneys

Desert Legal Group builds parenting plans for Avondale families, written to survive the ninth grade district change rather than fall apart at it.

Avondale, AZ Custody Attorneys
Committed to excellence in every case

Key Takeaways

  1. Arizona separates custody into legal decision-making and parenting time, and the court decides both on the best-interests standard in A.R.S. § 25-403.
  2. Avondale Elementary runs through eighth grade and feeds into Agua Fria Union High School District, so the school question reopens when your child starts high school.
  3. Our caseloads stay small on purpose, so an Avondale parent gets an attorney with time to prepare the case properly.

Overview

Most parents arrive with the same fear, which is that the process is going to be done to them rather than with them. That fear is reasonable. It is also avoidable if you know what the court is weighing before you walk in.

Our Avondale custody attorneys keep caseloads low so we can actually prepare your case. Call for a free consultation and we will walk you through what a realistic outcome looks like for your family.

How Arizona Decides Legal Decision-Making and Parenting Time

Legal decision-making is authority over the big questions, school, medical care and religious upbringing. Parenting time is the day to day schedule. Arizona treats them as two separate decisions.

Under A.R.S. § 25-403, the court decides both on the child’s best interests and considers all relevant factors, including each child’s relationship with each parent, adjustment to home and school, the mental and physical health of everyone involved, and which parent is more likely to support the child’s relationship with the other parent.

That last factor is the one people underestimate. Courts notice which parent makes the handover easy and which one makes it a negotiation.

Where your case is heard

Where an Avondale Custody Case Is Heard

Avondale is in Maricopa County. Maricopa County Superior Court hears family law at four locations, of which the Northwest Regional Center at 14264 W. Tierra Buena Lane in Surprise and the Central Court Building at 201 W. Jefferson Street in Phoenix are the two that come up for West Valley families.

The court assigns the case. Some hearings are held by video. The hearing notice tells you where and how, and it is the only source worth trusting on that.

The ninth grade handover

Avondale Parenting Plans Have a Built-In Expiry Date

Avondale Elementary School District covers kindergarten through eighth grade, with schools in Avondale and Goodyear. Litchfield Elementary covers parts of Avondale as well. Both feed into Agua Fria Union High School District, which serves Avondale, Goodyear, Buckeye, Waddell and Litchfield Park.

This is a structure most parenting plans handle badly. A plan drafted when a child is seven will name an elementary school and a district, and it will read as settled. Then the child finishes eighth grade, the elementary district’s authority ends, and the parents are back to a decision with no agreed answer.

Because school choice is legal decision-making, that decision needs both parents where legal decision-making is shared. Enrollment windows do not wait for parents to work it out, and a missed window is not a neutral outcome. It is a default in favour of whichever school the child is automatically assigned.

We draft Avondale plans that treat the ninth grade transition as a scheduled event rather than a surprise. The plan names the elementary district, names the high school district, sets a date by which the high school decision must be made, and says who breaks the tie.

Proving a move

What Actually Wins a Relocation Case

Relocation cases are decided on evidence, not on sympathy, and the parent who wants to move carries the burden of showing it serves the child.

The mechanics first. A.R.S. § 25-408 requires 45 days advance written notice before a child is moved out of state or more than 100 miles within Arizona, where both parents share joint legal decision-making or parenting time and both live here. Certified mail with return receipt, or another method the Arizona Rules of Family Law Procedure allow. The other parent then has 30 days to petition against it, and after that only good cause reopens the question.

What persuades a court is specific. A named job with a named salary. A signed lease with a school district attached. A concrete proposal for how the other parent keeps meaningful time, including who pays for the travel and how holidays change.

What does not persuade is a general sense that things will be better somewhere else. The court weighs the A.R.S. § 25-403 factors alongside the relocation factors in the statute, including good faith on both sides and whether the arrangement still gives both parents a realistic opportunity for parenting time.

If you are planning a move, start assembling that evidence before you send notice, not after.

You Can Trust Our Avondale Custody Attorneys

We would rather settle a custody case than try one, because a plan both parents agreed to is a plan both parents tend to follow. That preference has limits, and when the other side is being unreasonable we are comfortable in front of a judge.

The first consultation is free. Bring your order and, if your children are approaching ninth grade, bring the school question too.
