Divorce Attorneys for Business Owners in Gilbert, AZ
Desert Legal Group represents Gilbert practice owners, where the business is a licence, a patient list and one person’s reputation.

Key Takeaways
- A practice built during the marriage is presumed community property under A.R.S. § 25-211, even though only one spouse can lawfully hold the licence.
- Value attributable to the practice itself is generally divisible. Value that exists only because of the owner personally is argued differently.
- The automatic injunction under A.R.S. § 25-315 permits dealings in the usual course of business, which is narrower than most owners assume.
Overview
Gilbert has a dense population of owner-operated professional practices. Dental, medical, veterinary, therapy, accounting. They share a problem that a retail business does not have, which is that the licence cannot be split and the goodwill largely walks around inside one person.
That does not put the practice outside the marital estate. It changes how it gets divided. Call for a free consultation.
Is the practice community
A Practice Built During the Marriage Is Community Property
Under A.R.S. § 25-211, property acquired during the marriage is presumed community. A practice opened while married sits inside that presumption regardless of whose name is on the licence, and regardless of whether the other spouse ever set foot in it.
A.R.S. § 25-213 keeps separate a practice owned before the marriage, or acquired by gift or inheritance, together with its rents, issues and profits. Where community money funded the build-out and community effort grew the patient base, the community can acquire an interest in that growth.
On division, A.R.S. § 25-318 has the court return each spouse their separate property and divide the community equitably, though not necessarily in kind. Courts do not order two former spouses to co-own a practice.
Enterprise or personal
The Goodwill Argument Is the Whole Case
A practice has two kinds of value sitting on top of its equipment. Value belonging to the enterprise, which is the location, the systems, the staff, the recurring patient base and the referral relationships that would survive a change of owner. And value belonging to the practitioner, which is their personal reputation, their skill and their continued presence.
The distinction is decisive because it changes the number substantially, and both sides know it. The owner will characterise almost everything as personal. The other spouse will characterise almost everything as enterprise. Neither extreme survives a competent valuation.
What moves the argument is evidence. How much of the book would remain if the owner left tomorrow. Whether associates already carry a meaningful share of the work. Whether there is a covenant not to compete, and what a buyer in this market would actually pay.
Where a practice is genuinely one person, that usually reduces the divisible value and does not eliminate it. Equipment, receivables, the lease and the systems have worth regardless.
Running it meanwhile
What You Can and Cannot Do While the Case Is Pending
On filing, A.R.S. § 25-315 issues a preliminary injunction restraining both spouses from transferring, encumbering, concealing, selling or otherwise disposing of community property, except where related to the usual course of business, the necessities of life, or court fees and reasonable attorney fees, without written consent or the permission of the court.
That exception keeps the practice trading. Paying staff, ordering supplies, servicing the existing line of credit and meeting the lease are the usual course. Taking a new loan against the practice, buying out a partner, restructuring ownership or making a large distribution to yourself are not obviously the usual course, and an owner who assumes otherwise is exposed.
The injunction has the force of an order of the superior court signed by a judge and is enforceable by contempt. It binds the petitioner from filing and the respondent on service or actual notice, whichever comes first.
The workable approach is to get written consent or a court order for anything outside routine trading. It is slower and it removes an argument the other side would otherwise make about dissipation for the rest of the case.
