Divorce Attorneys for Business Owners in Paradise Valley, AZ
Desert Legal Group represents Paradise Valley owners whose interests sit inside holding companies, partnerships and family entities rather than in a business they run.

Key Takeaways
- Under A.R.S. § 25-211 an interest acquired during the marriage is presumed community, including a passive stake in an entity you do not control.
- Minority and non-controlling interests are valued with discounts that are argued rather than assumed.
- Operating agreements often restrict transfer, which limits what any decree can actually do.
Overview
Not every business owner runs a business. A substantial number of Paradise Valley clients hold interests in entities managed by someone else. Partnerships, funds, family holding companies, minority stakes in operating businesses.
That changes almost every practical question, starting with how much information you can even obtain. Call for a free consultation.
Is the interest community
Passive Interests Are Still Marital Property
A.R.S. § 25-211 presumes community ownership of property acquired during the marriage, and an entity interest bought or received during the marriage is inside that presumption whether or not either spouse has any role in running it.
The common exception here is real. A.R.S. § 25-213 keeps separate whatever was owned before the marriage or received by gift, devise or descent, together with its rents, issues and profits. Family entity interests frequently arrive by gift or inheritance and start as separate property.
They can still be complicated by community involvement. Where community funds met capital calls, or where a spouse’s work materially increased the value, a community claim can arise in part of the growth. Division then runs under A.R.S. § 25-318, equitably though not necessarily in kind.
Valuing a minority stake
Discounts, Documents and Limited Information
A non-controlling interest is not worth its arithmetic share of the whole. A holder who cannot force a distribution, compel a sale or direct management holds something less valuable than a controlling owner, and valuations reflect that through discounts for lack of control and lack of marketability.
The size of those discounts is argued in every case of this kind, and the difference between a defensible position and an opportunistic one is the quality of the expert and the evidence about how the entity has actually behaved.
Information is the practical obstacle. A spouse holding a passive stake may have nothing beyond an annual statement, and the entity is not a party to the divorce. Getting partnership agreements, capital account records and distribution histories may require subpoenas and time, and that time needs building into the case plan.
Transfer restrictions matter more than people expect. Many operating agreements prohibit transferring an interest without consent, which means a decree cannot simply hand half to the other spouse. The workable answer is usually an offset against other assets, or a structured share of distributions.
The injunction
The Injunction Reaches Passive Holdings Too
The automatic injunction under A.R.S. § 25-315 restrains both spouses from transferring, encumbering, concealing, selling or otherwise disposing of community property, subject to exceptions including the usual course of business.
For an owner who does not operate the business, there is very little that qualifies as the usual course. Accepting a distribution the entity declares in the ordinary way is one thing. Voluntarily transferring an interest into a trust, taking a loan against it, redeeming out, or agreeing to a restructuring that dilutes the holding are quite another.
Estate planning is where this most often goes wrong. Moving assets into trusts is an entirely normal activity in this town, and doing it after a petition is filed without consent or a court order is a breach carrying the force of a signed superior court order, enforceable by contempt.
If a capital call, a redemption or a planned restructuring arrives mid-case, deal with it through consent or an order. It is a solvable problem when raised in advance.
