Committed to excellence in every case

Key Takeaways

  1. Arizona separates custody into legal decision-making and parenting time, and the court decides both on the best-interests standard in A.R.S. § 25-403.
  2. Goodyear residents are served by four elementary districts and two high school districts, so a Goodyear child changes districts entirely between eighth and ninth grade.
  3. Low caseloads mean a Goodyear parent gets an attorney who knows the file, not one reading it in the hallway.

Overview

Parents come to us worried about the ordinary things. Whether they will still be the one at pickup. Whether the other parent is going to use this to cut them out. Whether the kids are going to be alright.

A parenting plan is where those worries get answered or ignored. Our Goodyear custody attorneys keep caseloads low so yours gets worked properly. Call for a free consultation and we will tell you what we actually think, including the parts that are not what you want to hear.

Arizona custody law

How Arizona Decides Legal Decision-Making and Parenting Time

Arizona divides custody into legal decision-making, meaning authority over school, medical care and religious upbringing, and parenting time, meaning the actual schedule.

Under A.R.S. § 25-403, the court decides both according to the child’s best interests and weighs all relevant factors, including the child’s relationship with each parent, the child’s adjustment to home and school, everyone’s mental and physical health, and which parent is more likely to allow frequent and meaningful contact with the other.

Nobody is being punished here. The court is trying to work out what the child’s week should look like.

Where your case is heard

Where a Goodyear Custody Case Is Heard

Goodyear is in Maricopa County, and Maricopa County Superior Court hears family law at four locations. West Valley cases typically involve the Northwest Regional Center at 14264 W. Tierra Buena Lane in Surprise or the Central Court Building at 201 W. Jefferson Street in Phoenix.

Assignment belongs to the court, not to geography, and some hearings are conducted by video. Check the hearing notice each time rather than assuming this appearance matches the last one.

Six districts, one city

Goodyear Children Change School Districts at Ninth Grade

The City of Goodyear tells residents plainly that they are served by four elementary school districts, Avondale, Liberty, Litchfield and Mobile, and two high school districts, Agua Fria Union and Buckeye Union.

That structure matters in a custody case for a reason that catches people out. The elementary districts run through eighth grade. At ninth grade the child leaves that district entirely and enters a high school district. So a parenting plan written when the children were small, naming a district and a school, can quietly expire the summer before high school.

Which high school district a Goodyear child enters depends on the address. Two families on opposite sides of the same city can be feeding into Agua Fria Union and Buckeye Union respectively, and a parent who moves across town may move the child between them.

School choice sits inside legal decision-making. If parents share that authority and the order says nothing more specific, the ninth grade transition becomes a decision that requires agreement, on a deadline set by an enrollment window rather than by either parent. We draft Goodyear plans that name the elementary district, name the expected high school district, and set out who decides if the parents cannot agree.

If the other parent moves

You Have Thirty Days, and It Starts Without You

Most relocation advice is written for the parent who wants to leave. This is for the one who does not.

Under A.R.S. § 25-408, a parent with joint legal decision-making or parenting time must give you 45 days written notice before moving your child out of state or more than 100 miles inside Arizona, served by certified mail with return receipt or another method the Arizona Rules of Family Law Procedure permit.

From the date that notice is made, you have 30 days to petition the court to prevent the move. That window is the whole game. Let it close and you can still petition, but only on a showing of good cause, and courts are not generous about what qualifies.

The good news is that the burden is not yours. The parent proposing the move has to prove it serves the child, against the A.R.S. § 25-403 factors and the relocation factors in the statute, including whether the move is being made in good faith and whether it leaves you a realistic opportunity for parenting time.

If a notice has arrived, call us the same week. Not the same month.

You Can Trust Our Goodyear Custody Attorneys

Our custody practice is built on preparation rather than volume. Most cases settle, which is usually better for the children and cheaper for the parents, but we do not treat settlement as the only acceptable answer.

A free consultation costs you an hour. Bring the order, the notice if you have received one, and your questions.
