Key Takeaways

  1. Under A.R.S. § 25-211 property acquired during the marriage is presumed community, which after a long marriage means most of the estate.
  2. A pension or retirement account earned partly before and partly during the marriage is divided by reference to the marital portion, not the whole balance.
  3. Marital misconduct does not affect the property division in Arizona, which is a question almost every client at this stage asks.

Overview

A divorce at sixty is a different problem from a divorce at thirty five. There is no career runway left to rebuild with, the estate is largely fixed, and both households have to be funded out of what already exists.

That changes what a good outcome looks like. It is less about winning a percentage and more about not ending up asset rich and cash poor. Call for a free consultation.

Community or separate

After a Long Marriage, Almost Everything Is Community

A.R.S. § 25-211 presumes that property acquired by either spouse during the marriage belongs to the community. After thirty or forty years, the practical effect is that the separate property claims are the exception and they need proof.

A.R.S. § 25-213 preserves what a spouse owned before the marriage or received by gift or inheritance during it. The difficulty in long marriages is that separate funds have usually been mixed into joint accounts and joint purchases decades ago, and tracing them now is a documentary exercise that may no longer be possible.

Under A.R.S. § 25-318 the court assigns separate property back and divides the community equitably, though not necessarily in kind, and without regard to marital misconduct. That last clause matters to a lot of people at this stage and the answer is that it does not change the property division.

Pensions and liquidity

Retirement Assets Are the Whole Case Here

Where a pension or retirement account was funded partly before the marriage and partly during it, only the marital portion is community. Establishing that share requires the plan records and the dates, and getting it wrong in either direction moves serious money.

Different plans divide by different mechanisms and on different timetables. Some can be split at once, some pay out only when the employee spouse retires, and some carry survivor benefit elections that have to be dealt with in the decree rather than afterwards. A decree that awards a share of a pension without addressing survivor benefits can leave the receiving spouse with nothing if the other dies first.

Liquidity is the other trap. Trading the house for the retirement accounts sounds even and often is not, because one asset generates income and the other generates property tax, insurance and a roof that will need replacing.

Tax again matters. A.R.S. § 25-318 lets the court consider obligations tied to property, including taxes accruing on receipt, and a pre-tax retirement balance is not worth the same as an equal number in cash.

Health insurance is the item most often forgotten. A spouse covered on the other one’s employer plan can lose that coverage on entry of the decree, and if they are not yet Medicare eligible the replacement cost belongs in the settlement arithmetic rather than as a surprise afterwards.

How we work

How We Handle a Grey Divorce in Surprise

We have acted for NFL players, professional athletes and public figures, whose careers end early and whose divorces therefore raise the same question yours does, which is how a finite pot funds a long future.

For a Surprise client the more relevant point is that we will model what each proposed split actually leaves you with year by year, rather than presenting a balanced spreadsheet and calling it fair.

Most of these resolve without trial, which is usually right when both parties will be living off the same finite estate.

You Can Trust Our Surprise High-Net-Worth Divorce Attorneys

Later-life divorces reward careful arithmetic over aggression. The goal is a settlement that still works in fifteen years, not one that looks good on the day.
